Monthly prizes will be awarded in the form of award certificates if they cannot be directly awarded to the winner. Award certificates expire one year from date of issuance unless otherwise specified below. This promotion is sponsored by The Arizona Super Bowl Host Committee ("Sponsor"). 1. HOW TO ENTER The promotional period begins on or about 12:01 AM MST August 12, 2006 and ends 11:59 PM MST January 1, 2008 (the "Promotional Period"). Entry is limited to one per person. Duplicate entries will be disregarded and may result in disqualification. There are two ways to enter the Arizona Super Bowl Host Committee Membership Club Raffle (the "Sweepstakes"):
2. ELIGIBILITY The Sweepstakes is open to legal residents of Arizona eighteen (18) years of age or older on or before August 12, 2006. Void where prohibited or restricted by law. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Entries must include the participant's name, valid email and mailing address and telephone number to be eligible to win. Persons in any of the following categories are NOT eligible to participate or win prizes in the Sweepstakes: (a) persons who are employees or agents of Sponsor, or its respective parents, subsidiaries, affiliated companies, or service agencies, or independent contractors of any of the above organizations; (b) individuals engaged, or employed by a company that is engaged in the development, production or distribution of materials for the Sweepstakes; and (c) persons who are immediate family (defined as mother, father, sister, brother, daughter, son or spouse) of any person in any of the preceding categories, regardless of where they live. All eligible entries for the Monthly Prize drawings will be included in the Grand Prize drawing. 3. CHOOSING WINNERS The winners of the Grand Prize drawing will be chosen by random drawing on or about January 8, 2008. The drawing will be conducted by Sponsor personnel. The winners of the Monthly Prize drawings will be chosen by random drawings on the first business day of the following month. All entry forms received after the close of the Promotional Period will be VOID and will be ineligible for prizes. All winners will be notified by e-mail and phone within seven (7) business days of the drawing. Information regarding the Sweepstakes winners will be posted on our website at www.azsuperbowl.com monthly during the Promotional Period and following the Grand Prize drawing. In order to claim a prize, winners will be required to execute a notarized affidavit of eligibility, a publicity release and a liability release, which must be completed and returned to Sponsor within (14) calendar days after notification or the prize will be forfeited. In the event of noncompliance, or if the winner cannot be reached at the phone number or e-mail provided on the winner's entry form, or if the prize is unclaimed, the prize will be forfeited and an alternate winner will be selected by random drawing. Note: You are not a winner of any prize until your compliance with these Official Rules has been verified and redeemed, in accordance with these Official Rules. 4. SWEEPSTAKES PRIZES At least eighteen (18) prizes will be awarded during the Sweepstakes. All prizes will be awarded in the form of award certificates, if they cannot be directly awarded to the winner. Restrictions may apply. SEE INDIVIDUAL AWARD DETAILS FOR SPECIFIC EXPIRATION DATES. Winners are responsible for all federal, state and local taxes and any other costs that may be incurred in claiming or using a prize. Should the actual value of any prize be less than the Approximate Retail Value stated, the difference will not be awarded in cash. Neither the Grand Prize nor the Monthly Prizes are transferable. Winner will be solely responsible for transportation to and from the game, food and drink at the game and all other expenses related to attending the game. 5. GENERAL CONDITIONS OF PARTICIPATION By participating in the Sweepstakes, participant agrees to abide by and be bound by these Official Rules. Prizes will only be awarded if participant fully complies with these Official Rules. No substitutions for prizes except by Sponsor in which case a prize of equal or greater value will be substituted. All entries become the property of Sponsor and will not be acknowledged or returned. By entering the Sweepstakes, participants agree Sponsor can use winners' names to post Sweepstakes results on its website at www.azsuperbowl.com. Except where prohibited, acceptance of prize constitutes consent to use winners' names and likeness for editorial, advertising and publicity purposes, without further compensation. Sponsor reserves the right to cancel or modify Sweepstakes if fraud or technical failure compromise the integrity of the Sweepstakes as determined by Sponsor in its sole discretion. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by holder of the email account on the date the entry was submitted. Entries that are lost, late, misdirected, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Sponsor' servers or elsewhere, will not be eligible. Sponsor, in its sole discretion, reserves the right to disqualify any person suspected of tampering with the entry process, the operation of the website or otherwise in violation of the rules. Sponsor further reserves the right to cancel, terminate, or modify any promotion not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort. If potential winners are not reached or do not pass preliminary verification questions within fourteen (14) calendar days of notification, the prize will be forfeited and an alternate potential winner will be selected. All decisions of Sponsor are final. Income and other taxes, if any, are the sole responsibility of the winners. Prizes are non-transferable. Please allow 4-6 weeks for delivery of prizes following close of the Sweepstakes. Prizes may be picked up by the winner at 9311 East Via de Ventura, Scottsdale, AZ, or will be delivered via courier service. 6. LIMITATIONS OF LIABILITY Sponsor is not responsible for computer, network, printing, typographical, human or other errors, problems or malfunctions relating to or in connection with the Sweepstakes, including, without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, the processing of entries or in any Sweepstakes-related materials; for stolen, lost, late, misdirected, undelivered, damaged, inaccurate, delayed, incomplete, illegible, or postage-due mail or entries; or for transactions that are lost, misdirected, or fail to enter into the processing system for any reason; or are processed, reported, or transmitted late or incorrectly; or are lost for any reason, including computer, telephonic, paper-transfer, or human error, or electronic, computer, or telephonic malfunction, damage, error, omission, interruption, defect, delay in operation or transmission, or any combination thereof. If, for any reason, the Sweepstakes is not capable of running as planned, or infection for computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of entrants, technical failures, or any other causes corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any entry or entrant and/or to cancel, terminate, modify, or suspend the Sweepstakes and at its sole discretion to disqualify any entry or entrant and/or to cancel, terminate, modify, or suspend the Sweepstakes and at its sole discretion award the prize for the drawing at issue from among all eligible non-suspect entries validly received for such drawing prior to the action requiring such modification. By participating, winner releases and agrees to hold harmless Sponsor, its parents, affiliates, subsidiaries and all of its respective directors, officers, employees, volunteers, representatives, subcontractors and agents (the "Released Parties"), from and against any and all liability for any loss, property damage or damage to persons, including, without limitation, death and injury, due in whole or in part, directly or indirectly, arising out of participation in the Sweepstakes, or participation in any Sweepstakes related activity, including acceptance, use, misuse, or possession of any prize (including any travel or activity related thereto). 7. DISPUTES Except where prohibited, participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. The Superior Court of Arizona, Maricopa County shall have jurisdiction and serve as the venue for any and all disputes arising from the Sponsor's raffle drawings. 8. CHOICE OF LAW All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, shall be governed by, and construed in accordance with, the substantive laws of the State of Arizona, without regard to Arizona choice of law rules. 9. ODDS OF WINNING Odds of winning depend on the number of eligible entries received. Entries received by postcard have an equal chance of winning. 10. LIST OF PRIZE WINNERS OR OFFICIAL RULES For the name of winners or a copy of these Official Rules, mail a postage pre-paid, hand-printed self-addressed stamped envelope to: Arizona Super Bowl Host Committee Membership Club Raffle, Winner's List or Official Rules, 9311 Via de Ventura, Scottsdale, Arizona 85258. Only one request for a Winner's List or Official Rules per envelope mailed. All requests must be received by February 8, 2008. Information regarding the Sweepstakes winners will also be posted on our website at www.azsuperbowl.com monthly during the Promotional Period and following the Grand Prize drawing.
